Registered Bidder: In order to bid on ANY item, you must be registered & have a bidder number. Nichols Equipment Inc., Auction DivisioN    reserves the right to refuse the registration of any person who does not comply with registration guidelines.
• Payment: Cash, Credit Card, or Check approved by Art Nichols. *Credit Card Processing Fee 3.75%.
• Sales Tax: Added to the purchase price of all taxable items.
• Warranty: All items sold AS-IS, Where-Is, with no warranties or guarantees expressed or implied on any items. No deduction will be allowed on   damaged articles as all goods being exposed for public exhibition are sold “as is” and without recourse. Buyer shall rely on their own inspection & information.
• Staff Bidding: We allow our staff to bid on items of interest. If they are bidding, they have completed the same registration process.
• Removal: All items must be paid in full before item can be removed from the property. Removal shall be at the expense, liability, and risk of the purchaser.
• Reserved Bids: We do have some reserved bids. We want to sell all items. The auctioneer reserves the right to reject any or all bids. He has the right to refuse a bid, to divide any lot or lots from the sale whenever the best interest of the seller will be served.
• Absentee Bidding: We do allow absentee bidding prior to auction.
• Security: We do have security onsite. You must show your paid receipt before you can leave with any item.
• Announcements: All announcements from the Auctioneer take precedence over all other printed material.
• Dispute Between Bidders: If a dispute arises, the decision of the auctioneer shall be final and absolute.
• Personal & Property Risk: Persons attending sale assume all risk of damage or loss to person and property. Neither auctioneer, nor auction company, shall be liable, by reason, of any defect in or conditions of the premises on which the sale is held. Every effort is made to “guard” merchandise throughout the auction; however, the bidder becomes solely responsible for all items purchased by him immediately following his winning bid. Therefore, he/she is advised to further guard his/her items at his/her own discretion.
• Responsible Bidding: The Bidder is responsible for knowing which item he/she is bidding on. If he/she is unsure, he/she should inquire or not bid. When you become the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor “mistakes”.
• Consignor Interest: The Auctioneer reserves the right to accept bids, in any increment, he feels is in the best interest of the consignor. The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or comments, he feels, are not in the best interest of the consignor.
• Buyer’s Premium: 10% on each item (up to $3,001) *Anything over $3,001 is lowered to 6%.
